Privacy and cookies.

This policy explains what personal information we collect when you visit arthursleep.com, buy from us, book an appointment or get in touch, how we use it, and the choices and rights you have.

1. Who we are

1.1 Asleeptrading Limited, trading as Arthur Sleep, is the controller of your personal information. We are registered in England and Wales, company number 15521461. Our registered office is 109 Snakes Lane, Woodford Green IG8 0DY, and our trading address is 124 Mount Street Mews, London W1K 3NR, United Kingdom.

1.3 For any question about your personal information, email hello@arthursleep.com or write to us at 124 Mount Street Mews, London W1K 3NR, United Kingdom.

1.4 We handle personal information in line with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018 and the Privacy and Electronic Communications Regulations 2003.

2. What we collect

2.1 Orders. Your name, delivery and billing addresses, email address, telephone number, what you ordered, and confirmation of your payment. Card details are handled by our payment providers; we do not see or keep your full card number.

2.2 Appointments and forms. When you book an appointment, ask us to call you or write to us through a form on the website: your name, contact details, the times that suit you and anything you choose to tell us.

2.3 Messages. When you message us on WhatsApp, email us or call us: your number or address, your name, and the messages and photographs you send.

2.4 Measurements and fitting notes. Your sizes, the measurements we take of your feet, and our notes from your appointments and fittings. If you tell us about a foot or health condition so that we can allow for it, we use that only to make and fit your shoes, and only with your explicit consent.

2.5 Newsletter. Your email address, and whether you open our emails and follow their links.

2.6 Visiting the website. Information about your device and browser, your IP address, the pages you view and how you reached us. We collect this through cookies and similar technologies, as set out in section 7.

2.7 Gifts. If someone gives you a gift card or a commission gift, they may give us your name and contact details so that we can deliver it.

2.8 Children. Our website is not intended for anyone under 16, and we do not knowingly collect information from children online. If you believe a child has given us personal information, please contact us and we will delete it.

3. How we use it, and our lawful bases

3.1 To take, make, deliver and, where needed, accept the return of your order, and to provide bespoke appointments, fittings and recraft work. Lawful basis: our contract with you, or steps you ask us to take before entering into one.

3.2 To keep accounts and tax records, and to meet our legal duties, for example for VAT, customs and CITES permits. Lawful basis: legal obligation.

3.3 To answer your messages, arrange appointments, keep your measurements and fitting notes so that we can make further pairs and recraft yours, prevent fraud, keep the website secure and improve our service. Lawful basis: our legitimate interests in running and improving our business, balanced against your rights.

3.4 To send you our newsletter and other marketing emails. Lawful basis: your consent. Every email has a link to unsubscribe.

3.5 To measure how the website is used, and to show you our advertising on other websites and apps. Lawful basis: your consent, given through our cookie banner.

3.6 To use any health information you give us (section 2.4). Lawful basis: your explicit consent, which you may withdraw at any time.

3.7 We do not sell your personal information.

4. Who we share it with

4.1 We share personal information only with organisations that help us run our business, and only as far as they need it:

(a) Shopify, which runs our online store, checkout, customer records and website forms. Shopify protects its forms from spam with hCaptcha.

(b) Our payment providers, including Shopify Payments and any wallet you choose at checkout, such as Apple Pay, Google Pay or Shop Pay, to take payment and prevent fraud.

(c) DHL, to deliver your order and clear it through customs.

(d) Klaviyo, to send our emails.

(e) Meta (Facebook, Instagram and WhatsApp), for messages you send us on WhatsApp and, with your consent, for advertising.

(f) Pinterest, with your consent, for advertising.

(g) Google, with your consent, for website analytics and advertising.

4.2 Meta, Pinterest and Google also use some information for their own purposes, under their own privacy policies.

4.3 We may also share information with our professional advisers; with government authorities where the law requires it, for example HMRC, customs authorities and the authority that issues CITES permits; and with a buyer of our business, who would continue to protect it as this policy describes.

5. Transfers outside the UK

5.1 Some of the organisations in section 4 store or process information outside the UK, for example in the European Union, Canada and the United States. When this happens, the transfer is protected by UK adequacy regulations, the UK Extension to the EU-US Data Privacy Framework, or the UK’s approved contract clauses.

5.2 When we deliver an order outside the UK, we must share your delivery details with DHL and the customs authorities of the country you are in.

6. How long we keep it

6.1 Orders, invoices and accounting records: 6 years from the end of the financial year they relate to, as tax law requires.

6.2 Measurements and fitting notes: for as long as you remain our client, so that we can make further pairs and recraft yours, or until you ask us to delete them.

6.3 Messages and appointment requests: up to 2 years after our last contact with you, unless they form part of an order.

6.4 Newsletter: until you unsubscribe. We then keep your email address on a list of people not to email, so that we respect your choice.

6.5 Cookies: for the periods set out in our cookie banner.

7. Cookies and your device

7.1 Cookies are small files that a website stores on your device. When you first visit arthursleep.com, our cookie banner asks for your consent. Cookies that the website needs in order to work, such as those that keep your bag, run checkout, keep the site secure and remember your cookie choice, are always on. Analytics and advertising cookies are used only if you accept them.

7.2 Analytics cookies, from Shopify and Google, tell us how the website is used. Advertising cookies and tags, from Meta, Pinterest, Google and Klaviyo, help us show you our advertising and measure it.

7.3 You can change your choice at any time through the cookie settings link at the foot of every page, or by clearing cookies in your browser. Shopify publishes the cookies its stores use at shopify.com/legal/cookies.

7.4 Your shoe size. When you choose a shoe size, the website remembers it in your browser’s own storage, so that it can suggest a size on other pairs. It stays on your device and is not sent to us. You can remove it by clearing this website’s data in your browser.

8. Your rights

8.1 You have the right to: ask for a copy of your personal information; ask us to correct it; ask us to delete it; ask us to restrict how we use it; object to how we use it, including the absolute right to object to marketing; ask us to send it to you or another organisation in a portable form; and withdraw your consent at any time, where we rely on it.

8.2 To use any of these rights, email hello@arthursleep.com. There is no charge. We reply within one month, and we may ask you to confirm your identity first.

8.3 We do not make decisions about you that have legal or similarly significant effects using automated processing alone. Shopify’s fraud screening may temporarily block a payment attempt that looks suspicious; if that happens, please contact us.

9. Security

9.1 We keep personal information secure, limit access to the people who need it, and choose service providers who protect it.

10. Complaints

10.1 If you are unhappy with how we have used your personal information, please tell us first, at hello@arthursleep.com.

10.2 You also have the right to complain to the Information Commissioner’s Office: ico.org.uk, or 0303 123 1113.

11. Changes to this policy

11.1 We may update this policy from time to time. The date at the top shows when it last changed.
